How does Florida define sexual domestic violence?

The Florida Statutes define sexual domestic violence as any domestic violence that includes sexual assault or sexual battery that results in physical harm or death of a member of your household or family by another member of your family or household. Sexual assault includes situations in which you feel that there is a threat of bodily harm even if the aggressor does not touch you. Sexual battery includes domestic violence in which you are physically touched by the aggressor. If you have experienced either threatening or physical sexual abuse from a member of your household or another family member, you need immediate legal representation. Call Boca Raton family law attorney Matthew D. Martin now at  (561) 406-8555 to discuss your legal options.

How can I stop sexual domestic violence?

One way to curb sexual domestic violence is to petition the Court for an injunction against the aggressor. Under certain circumstances, the person that is perpetrating the sexual domestic violence does not have to be in court for the temporary injunction to go into effect. The court will look at the factors listed in the Florida Statutes and any other relevant information to determine whether there is reasonable cause to believe that sexual domestic violence is imminent. Some of these factors are:

  • The history between you and the aggressor (threats, harassment, stalking, physical abuse).
  • Any situation in which the aggressor has restrained you from leaving the home or dwelling.
  • A criminal history of violence.
  • Destruction of property, such as telephones, clothing or other items that you own.
  • Other facts and circumstances not listed.

Mr. Martin can and help you efficiently sift through the legal complexities of petitioning for the injunction and to help prevent future instances of sexual domestic violence.
